As you’re getting ready to embark on your summer road trips, make sure your driving habits don’t turn into a life-altering traffic stop. Virginia’s traffic laws can be especially strict: driving 20 miles per hour over the speed limit or driving any speed in excess of 80 miles per hour can result in a reckless driving ticket.
What are the maximum penalties for a reckless driving ticket in Virginia? Well, it could get harsh:
- Up to 12 months in jail.
- 6 month license suspension.
- Fines up to $2,500.
- 6 points on your license.
Likewise, as a class 1 misdemeanor, reckless driving could result in steep rises in your insurance premiums as well. So simply going to court, pleading guilty, and paying the fine may cost you more in the long run. It is smart for you to hire an attorney. Often, without legal expertise, people are unable to properly defend themselves.
If you appear in court dressed professionally with a lawyer at your side, you convey to the judge your understanding of the seriousness of the charges, which can significantly improve the outcome of your case.
A lawyer may challenge the circumstances of the stop, the calibration of your speedometer, as well as the maintenance of the radar device. These arguments may get your reckless driving charges reduced to an improper driving charge or a simple speeding ticket, which are not misdemeanor offenses. This outcome, while not guaranteed, could save you thousands of dollars in fines, fees, and insurance increases, as well as keeping your criminal record clean.
TIP: Some officers may only write “RD” on the ticket, which stands for reckless driving. If you aren’t prepared for it, you may be surprised to find out that you have been charged with a criminal offense.
